1. About Fix My Boat NZ

Fix My Boat NZ ("the Platform", "we", "us") is an online directory and marketplace that connects boat owners with marine trades and facilities in New Zealand. The Platform is owned and operated by BT Ventures Ltd, New Zealand.

By accessing or using the Platform you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

2. Directory and Marketplace — Not a Party to Agreements

Fix My Boat NZ is a venue only. We are not a party to any agreement, contract, or arrangement made between boat owners and marine trades via the Platform. We do not employ, endorse, recommend, or warrant any trade, tradesperson, or facility listed on the Platform.

Any agreement you reach with a trade or facility is solely between you and that party. We accept no liability for the performance, quality, safety, legality, or any other aspect of goods or services provided by trades or facilities listed on this Platform.

3. No Guarantees About Listed Trades or Facilities

We make reasonable efforts to keep listings accurate but we do not verify the qualifications, licences, insurance, or suitability of any trade or facility. You are solely responsible for conducting your own due diligence, including (but not limited to):

• Verifying that a tradesperson holds any required licences or certificates.
• Confirming that a tradesperson carries appropriate insurance.
• Checking references and reviews before engaging a trade.
• Reviewing the terms, pricing, and scope of any work agreement directly with the trade.

4. Job Templates and Agreements

Any job templates, agreement templates, or document examples available on the Platform are provided for general informational purposes only. They do not constitute legal advice and are not tailored to your specific circumstances. You should obtain independent legal advice before relying on or signing any agreement. We accept no liability for losses arising from use of these templates.

5. User Accounts and Listings

You are responsible for maintaining the confidentiality of your account credentials. You agree not to list false, misleading, or fraudulent information. We reserve the right to remove any listing or suspend any account at our sole discretion, without notice or liability.

6. Limitation of Liability

To the maximum extent permitted by the Consumer Guarantees Act 1993, Fair Trading Act 1986, and all other applicable New Zealand law, we exclude all warranties, conditions, and guarantees in relation to the Platform and its content. We will not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Platform or from any transaction entered into via the Platform.

Where liability cannot be excluded under New Zealand law, our total aggregate liability is limited to NZD $100.

7. Third-Party Links and Content

The Platform may contain links to external websites or display content provided by third parties. We are not responsible for the content, accuracy, or practices of any third-party site. Links do not imply endorsement.

8. Intellectual Property

All content on the Platform created by Fix My Boat NZ — including design, copy, and code — is our intellectual property. Trade and facility listings remain the property of the relevant trade or facility owner. You may not reproduce, distribute, or commercialise our content without prior written consent.

9. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on this page with a revised date. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
